Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Pantheon (“we,” “us,” or “our”) governing your access to and use of pantheonculture.com and any related services (collectively, the “Platform”). By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Our Services
Pantheon is a pop culture voting and ranking platform where users cast votes, follow lists, debate rankings, and collectively build the definitive cultural record across music, sports, film, literature, and other categories. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice.
2. Intellectual Property Rights
The Platform and its original content — including the scoring methodology, design, code, graphics, logos, list structures, and editorial content — are owned by Pantheon and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any portion of the Platform without our express written permission.
You retain ownership of any content you submit to the Platform (such as votes, comments, or profile information). By submitting content, you grant Pantheon a worldwide, non-exclusive, royalty-free license to use, display, store, and distribute that content in connection with operating and improving the Platform. 3. User Representations
By using the Platform, you represent and warrant that:
- You are at least 13 years of age (or the minimum age required in your jurisdiction).
- All registration information you provide is accurate, current, and complete.
- You will maintain the accuracy of your account information and promptly update it if it changes.
- You have the legal capacity to enter into these Terms and will comply with them.
- You will not access the Platform through automated means (bots, scrapers, crawlers) without our express permission.
- Your use of the Platform does not violate any applicable law or regulation.
4. Prohibited Activities
You may not engage in any of the following when using the Platform:
- Using the Platform for any unlawful purpose or in violation of any applicable law.
- Attempting to manipulate rankings, votes, or scores through artificial means, bots, coordinated inauthentic behavior, or vote fraud.
- Impersonating another user, Pantheon staff, or any real person or entity.
- Uploading or transmitting malware, viruses, or other malicious code.
- Scraping, harvesting, or collecting user data from the Platform without authorization.
- Attempting to circumvent authentication, access controls, or security features of the Platform.
- Harassing, threatening, or intimidating other users.
- Submitting false, misleading, or defamatory content.
- Using the Platform to send unsolicited communications (spam) or promotional material.
- Interfering with or disrupting the integrity or performance of the Platform or its infrastructure.
- Attempting to reverse-engineer, decompile, or extract the Platform's source code or scoring algorithms.
5. User-Generated Contributions
The Platform allows you to submit votes, follow lists, create a profile, and potentially post comments or other content (“Contributions”). By submitting any Contribution, you represent that:
- Your Contribution is your own original expression and does not infringe any third-party rights.
- You have the right to grant the license described in Section 6.
- Your Contribution does not contain material that is defamatory, obscene, harassing, or otherwise objectionable.
- Your Contribution does not contain personal information about third parties without their consent.
Pantheon does not endorse or guarantee the accuracy of any user Contributions. We reserve the right to remove any Contribution that violates these Terms or that we determine, in our sole discretion, is harmful to the Platform or its users.
6. Contribution License
By submitting any Contribution to the Platform, you grant Pantheon a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, display, distribute, and create derivative works from your Contribution in any medium or format, in connection with operating, promoting, and improving the Platform. This license does not affect your ownership of your Contributions. You may request deletion of your account and associated Contributions at any time, subject to our data retention policies.
7. Service Management
Pantheon reserves the right, but not the obligation, to: (1) monitor the Platform for violations of these Terms; (2) take appropriate legal action against anyone who violates these Terms, including reporting such users to law enforcement; (3) remove or disable access to any Contribution that is excessive in size or is in any way burdensome to our systems; (4) suspend or terminate any user account for violation of these Terms; and (5) manage the Platform in a manner designed to protect our rights and property and to facilitate the proper functioning of the Platform.
8. Term and Termination
These Terms remain in full force while you use the Platform. We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. If we terminate your account for cause (such as violation of these Terms), you may not re-register without our express written consent.
You may terminate your account at any time by contacting us at legal@pantheonculture.com or through your account settings. Upon termination, your right to use the Platform will immediately cease.
9. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Platform at any time without notice. We are not liable for any modification, suspension, or discontinuation of the Platform. We cannot guarantee the Platform will be available at all times. We may experience hardware, software, or other problems that require maintenance or cause downtime. We are not liable for any inconvenience, loss, or damage caused by any downtime or discontinuation of the Platform.
10. Governing Law
These Terms and your use of the Platform are governed by and construed in accordance with the laws of the United States applicable to agreements made and to be entirely performed within the United States, without regard to conflict of law principles.
11. Dispute Resolution
Informal Resolution
Before filing any formal legal claim, you agree to first attempt to resolve the dispute informally by contacting us at legal@pantheonculture.com. We will attempt in good faith to resolve any dispute within 30 days of receiving notice.
Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration, rather than in court, except that either party may bring claims in small claims court if the claim qualifies.
Waiver of Class Actions
You agree that any arbitration or proceeding shall be limited to the dispute between you and Pantheon individually. You waive your right to participate in class action lawsuits or class-wide arbitration.
12. Disclaimer
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PANTHEON DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
13. Limitations of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PANTHEON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM: (1) YOUR USE OR INABILITY TO USE THE PLATFORM; (2) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS; (3) ANY CONTENT SUBMITTED BY OTHER USERS; OR (4) ANY OTHER MATTER RELATING TO THE PLATFORM. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS.
14. Indemnification
You agree to defend, indemnify, and hold harmless Pantheon and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including any content you submit, your violation of any third-party rights, or your violation of any applicable law.
15. User Data
We collect and process certain data about you in connection with your use of the Platform. By using the Platform, you consent to our collection and use of data as described in our Privacy Policy, which is incorporated into these Terms by reference.
16. Electronic Communications and Signatures
By using the Platform or sending us emails, you consent to receiving electronic communications from us. You agree that all notices, agreements, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree that your electronic submission of votes, account registrations, and acceptances constitutes your electronic signature and has the same legal effect as a handwritten signature.
17. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pantheon regarding the Platform and supersede all prior agreements and understandings.
Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Changes to Terms. We reserve the right to update these Terms at any time. We will notify registered users of material changes via email or in-app notice. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
